Meaning, if someone files a libel suit against one of our members, and I can't provide said member's real name and address (or some other ID), I'm on the hook for the damages. |
Depends where you're located however... The tricky issue is that one of jurisdiction can be raised, along with the argument that no New Jersey court has jurisdiction over the sovergn state of whatever, or the sovergn country of whatever...
Case in point, for instance is that if a site was located on an over-seas ISP and managed from there, trying to haul foreigners before their court could be met with "we are under no legal obligation to step foot in your country, try to get us..." Of course, they can't, having no legal authority in another country...
In fact, one of my Tai Chi teachers is also a lawyer wrt copyright law, and in reference to when the MPAA threw a hissy fit over DeCSS and some other stuff, (including a Russian programmer), her immediate reaction was "that's odd They have no grounds to expect they'll stand trial in our country, when they don't have to enter, and we have no authority to try to collect them (short of military action, or a diplomatic agreement with the foreign government for instance) and bring them here..." Try to negotiate that people in China, North Korea, or other such "unfriendly nations" turn people over to stand trial in NJ courts; I could imagine their respective governments and people such as King Jong Ill would go tell the prosecutors in NJ where they can go send themselves, before cooperating with such a request for extradition... Would the feds be willing to make an international incident out of it, to help NJ enforce it's law? Somehow I'm not sure they would...
The RIAA tried it in one court in CA (I think it was), until a judge finally told them they can't mass file against the world in his court. The argument again was "This court has no jurisdiction over the sovergn state of... If they're following the laws of their own jurisdiction, it's good enough for me. You got a complaint wrt their own law, file it there..." Wonder when some of these people will learn that they can't legislate the whole world from their own tiny corner of it...
BTW, I grew up in New Jersey till I was 16. Haven't lived there in over a decade however... |

has any other Brit posted one this subject about the nonsense that slashdot represents (being an old slashdotter myself).
Oh, yes, and the fact that some of us are still refusig to integrate into Tony's GW clone programme (see, we even spell that wrong).

I'm disapointed in this bill. Hmmm... I can't help but wonder if it's part of some greater scheme.

Edit: That's in response to Mr. Snrub's post. However, MySpace isn't a good reason for this to become law either. |
I totally agree, Myspace should just be shut down and the owners jailed.
|
Yes, shut down Myspace. Doesn't Rupert Murdoch own Myspace? |

Do you think it will pass? the wording is a bit iffy. The law states that it would be possible for anyone to be to demand the public info on any member. Wouldn't that just be handing children's information over to the very people we say we are trying to protect them from? I mean come on!
Here is what the Law Geek had to say
<http://lawgeek.typepad.com/lawgeek/2006/03/new_jersey_asse.html> about the law. I don't think it will pass in it's current form.
just my thoughts of course

I have some trouble seeing something like this passing straight through, and especially then not receiving more then a few legal challenges that either render it null and void, or result in sites just picking up their bags and moving over seas where no jurisdiction (and hence ability to enforce the provision) is possible.
And before we even get there; one's got marketing firms and advertizers who would just die for everyone's personal info if they can get ahold of it. There would also be the possibility for undesireables (sex offenders for instance), as well as, just imagine if Osama Bin Laden made such a request through another and it was found out after the info was out there...
Not having one's identity known to all and sundry can itself be a protection, oh identity theft can be another. Not that the info on the forum alone would be enough to steal one's identity, but it has happened before. Hell, someone got my parents credit card number off a slip and started charging copious amounts of fraudulent purchases to my father's credit card. He had to deal with that one promptly... |

no way the courts will allow this. Newspapers dont have to have this kind of info to publish letters to the editor.

Sorry, but being a Son of Albion myself, can someone help me understand if the U.S. government would be able to commit such a blatent breach of personal privacy? Leaving the Myspace stuff to one side, I personally think that what's private stays private. I don't know if the U.S. President has an opinion on this...mind you, I,m not sure that he has an opinion about anything, really.... _________________ A Shrubbery For Prez!

JMO = Just My Opinion?
As much as I would like to agree with Alpha, nobody get to be President if they are an idiot. There is a plan, and some real political power backing that plan, and the result we see looks like an idiot is running the show. I suspect that somebody, somewhere, is actually quite pleased with the way things are now (oil*companies, for a start) which is a very scary thought indeed.
All in all, I'd prefer a real idiot.

I'd like to be the president.
It's wonderful the way the Secret Service (SS) clear all the intersections when you're driving around so that you're never bothered by things like traffic.
You get to go up in a really cool aeroplane that cuts to the front of the departure line.
Then there are the starlets in Lincoln's bedroom. They pay lots and lots of US dollars for the privilege....hehe
And all those sycophants telling you how wonderful you are.
Why won't they let us foreign born types be the president?
I'm not green like those aliens in New Mexico.
Arnold wants to be president.
So do I.

No, no, no......... More BUSH, I mean, not more President Bush or Lady Bush. Well not exactly. Perhaps a little "lady" bush. That is of course unless you wanted a little "lady" shrubbery. But I do not think that would be as much fun.
