|
|
Found this on Slashdot:
"The New Jersey legislature is considering a bill that would require operators of public forums to collect users' legal names and addresses, and effectively disallow anonymous speech on online forums. This raises some serious issues, such as to what extent local and state governments can go in enacting and enforcing Internet legislation."
The bill itself.
Now, this will likely never become a law, and if it does, it should be struck down as unconsitutional. However, if you live in New Jersey, contact your representatives and tell them to vote NO. I'd rather not have to start collecting names and address of our members as a CYA move in the event that this does become law and we somehow become the test case and lose. _________________ KWSN Forum Admin

Can't you just ignore it even if does pass until they try to enforce it?

Yes, but:
the bill wrote: | In addition, the bill makes any operator or Internet service provider liable for compensatory and punitive damages as well as costs of a law suit filed by a person damaged by the posting of such messages if the operator or Internet service provider fails to establish, maintain and enforce the policy required by section 2 of the bill. |
Meaning, if someone files a libel suit against one of our members, and I can't provide said member's real name and address (or some other ID), I'm on the hook for the damages. _________________ KWSN Forum Admin

What in the world does NJ expect to gain from this? My wife moderates a forum for people with sexual problems with their spouse. I can't fathom what a block on anonymous posting would do to that sort of service, much less one's that deal with mental health or substance abuse problems. The internet can be an extrememly valuable tool for people with issues that are embarrasing to talk about elsewhere. _________________

I'd imagine it has something to do with preventing/prosecuting illegal activities. _________________ KWSN Forum Admin

Myspace is a good example of why this may become law.
Those guys need some hard lessons as that place is for pedophiles, under age people to cuss, talk smack and drugs. To many people have met up with other myspace twerps and died.
DO YOU KNOW WHAT YOUR KIDS ARE DOING ON LINE?
I don't like MySpace for any reason. _________________ Don't fuss about growing older, many are denied the chance. |

That's an even worse reason.
Edit: That's in response to Mr. Snrub's post. However, MySpace isn't a good reason for this to become law either. _________________ KWSN Forum Admin

My kids are young right now and their computer is ridiculously filtered, only allowing access to sites that I have whitelisted. When they get a little older, I'll open things up a bit, but will log every single keystroke on machines in their rooms. It's pretty easy to remove the MAC address of the wireless cards from the list in my router, after all! If they try to disable the logging, I'll know and I won't hesitate to remove the priviledge of internet from their rooms.
Myspace is also great place for musicians to meet and show their work. Some of my songs will go up soon. It is not their fault that the site is abused by some people. A little precaution on the part of kids' guardians should go a long way in preventing these shenanigans, while preseving anonymity to those who really need it for sensative topics. _________________

Surely this would only apply to NJ residents? Or would NJ-based sites have to collect international real identities? _________________ Creationists believe they never evolved; I agree with them.

The way it's worded, it sounds like it could be applied to any site that's available to NJ residents, but IANAL. _________________ KWSN Forum Admin

I totally agree, Myspace should just be shut down and the owners jailed.
NJ is a little bit on the nutz side. Sorry Jammy. _________________ Don't fuss about growing older, many are denied the chance. |

I don't have a problem with what you are doing, have you ever went on and read some of the profiles from the kids there? My 11 year old granddaughter went on there from her friends house(no those parents didn't give a crap what their kids were doing as long as they didn't bother them). My daughter cared and had filters up the wazzou, so my granddaughter put up a profile that made all our heads stand on ends. All of us contacted Myspace and guess what, her profile is still there. Once it's put there it will stay. My daughter has a case in court now trying to get it off.
This is why I have a problem with Myspace. If you go to Myspace on your PC, your children can go there, just keep an eye out. I guess I'm disgruntle with that place and speak against it every chance I get.
(ETA my granddaughter at 11 had 50+ year old men hitting on her, at least she was smart enough not to put her address out there, she did her phone number and the police got involved then. When she stayed here for 3 months, I password protected my PC's so she couldn't get on there.) _________________ Don't fuss about growing older, many are denied the chance.

Um, no....we seems to have completely opposing viewpoints on MySpace, even though neither of us like it. However, that's not a topic for this thread. _________________ KWSN Forum Admin

NJ legislature is a bunch of twits, but society in general has lost contact with the idea of parental supervision.
If something bad happens to anyone ever it's someone elses fault.
When you make society so "safe" that people don't have to worry about their own safety, people stop trying and everyone is more at risk. It all comes down to being responsible for yourself and those under your care/supervision.
Laws won't stop bad people from being bad. Bad things happen. Life is unfair, etc. Deal with it and conduct your life accordingly. With that philosophy the world would be a much better place for all of us. _________________ A Shrubbery for Prez. Let's put more bushes in the whitehouse.
